DECLARATION AND ACCEPTANCE

APPLICATION TERMS AND CONDITIONS

  1. I/We hereby apply to be appointed as a Smart User Program participant for Program MakanMadu.com.
  2. I/We understand that my/our appointment does not make me an employee or a legal representative of my/our MakanMadu.com Sponsor, or MakanMadu.com, or give me/us any authority to speak on behalf of or bind my/our sponsor or MakanMadu.com
  3. I/We will operate my/our own MakanMadu.com business, buying and selling MakanMadu.com products from my/our own account. I/We may also sponsor other people as participant.
  4. I/We will not make any claims, representations or statements about MakanMadu.com or its products except as authorised in official MakanMadu.com Literature.
  5. I/We will only disseminate official MakanMadu.com Literature. I/We will indemnify MakanMadu.com against any legal liability arising out of unauthorised claims and representations or statements made by me/us. I/We agree to comply with the MakanMadu.com Sales and Marketing Plan as set forth in official MakanMadu.com Literature and manuals, and observe the spirit as well as the letter of the MakanMadu.com Rules of Conduct and abide by the requirements set forth in the relevant legislation with respect to Direct Sales.
  6. I/We also agree to upgrade my participation status to VIP Status by purchasing the MakanMadu.com VIP Package to qualify Me/We to share My/Our Links, purchase products and earn commissions from MakanMadu.com.
  7. I/We agree to provide MakanMadu.com with my/our bank account/payment information together with all other information and documents requested by MakanMadu.com pursuant to MakanMadu.com’s Rules of Conduct so that MakanMadu.com will be able to pay me/us my/our bonuses and/or other payments.
  8. I/We understand that, notwithstanding the fact that I/we may specify a particular account for the payment of bonuses and/or other payments, the payment methods are subject to MakanMadu.com’s sole discretion.
  9. I/We understand that my/our membership may be revoked if I/we fail to comply with the above conditions. I/We also understand that there will be no refunds, after the expiry of my/our membership.
  10. I/We understand that upon the expiry of the grace period for non-renewal or in the event of termination or resignation of the membership, my/our right to any bonuses and/or other payments will be forfeited, regardless of when my/our right arose.
  11. I/We hereby authorise membership to store and transmit the above data electronically.
  12. I/We certify that my/our Line of Sponsorship (LOS) as an participant as listed above is correct and that if this is not my/our first application to become an participant, my/our LOS is the same as under my/our previous membership. If my/our membership application is not within the same LOS, my/our previous membership, or that of my spouses, has expired for at least three months and I/we have neither bought nor sold MakanMadu.com products nor taken part in any MakanMadu.com activities within that period except as a retail customer.
  13. I/We hereby certify that the information provided above is true and correct, and that I am/we are 18 years of age or older.
  14. I/We hereby acknowledge that I/we am/are aware and accept that under MakanMadu.com’s Rules of Conduct, a husband and wife partnership shall be regarded as a separate membership.
  15. I/We agree and accept I am/we are registering MakanMadu.com/Kelulut Shoppe Marketing either as a new participant to purchase MakanMadu.com products.
  16. I/We authorise and consent to my/our Personal Data and Sensitive Personal Data being collected, used, processed, stored and/or disclosed to authorised third parties as identified by MakanMadu.com/ Kelulut Shoppe Marketing for the purposes of providing me/us its products and the necessary information to assist me/us to conduct the business effectively and ethically. In addition, I/we also explicitly provide my/our consent to MakanMadu.com/ Kelulut Shoppe Marketing to process any sensitive personal data that are relevant for such purposes.

 

BONUS PAYMENT TERMS AND CONDITIONS

1.            I/we the undersigned, understand that MakanMadu.com/ Kelulut Shoppe Marketing may during my/our membership, make payments of bonuses and/or other payments to me/us from time to time as incentives for my/our performance goals.

2.            The assessment for bonuses and/or other payments pursuant to MakanMadu’s Sales and Marketing Plan is subject to MakanMadu.com’s sole discretion.

3.            I/we agree that all rights in the MakanMadu membership shall remain in the name of the principal applicant in accordance with my/our registration.

4.            I/we agree to provide my/our bank account/payment information together with all other information and documents requested by MakanMadu.com pursuant to MakanMadu’s Rules of Conduct to facilitate the payment of my/our bonuses and/or other payments. I/we further understand that no third-party account can be submitted.

5.            I/we agree that makanmadu.com deducts an amount of my/our bonus that I/we withdraw from my/our makanmadu.com membership account every month automatically which is intended as payment for the purchase of 1 unit of a specific product along with the postage cost as my/our monthly purchase for meet my/our bonus payment eligibility every month and I/we also agree that makanmadu.com will pay the balance of my/our bonus withdrawals to my/our bank account after deducting monthly purchases on every 1st to 5th day of the following month.

6.            I/we understand that notwithstanding the fact that I/we may specify a particular account for the payment of bonuses and/or other payments, the payment methods are subject MakanMadu.com’s sole discretion.

7.            I/we understand that upon the expiry of the grace period for non-renewal or in the event of termination or resignation, my/our right to any bonuses and/or other payments will be forfeited, regardless of when my/our right arose.

7.            In the event of a dispute between the parties to the membership, I/we agree that all bonuses and/or other payments will continue to be paid in accordance with the last payment instruction to maintain the status quo until such time a mutual agreement is reached as to which party will operate the membership.

9.            I/we hereby warrant that all particulars submitted herein are true to the best of my/our knowledge and agree to indemnify MakanMadu.com and hold MakanMadu.com safe and harmless against any loss or damage which may arise for any claims whatsoever, whether in contract, tort or otherwise which may arise from my/our breach of the MakanMadu.com Rules of Conduct and all relevant terms and conditions.

10.          Bonuses and/or other payments to a legal entity (which acceptance of such application is subject to MakanMadu.com y’s rights pursuant to the MakanMadu.com Rules of Conduct) shall be paid into an account operated by such legal entity. No personal account shall be permissible in such an instance.

11.          Notwithstanding this policy, MakanMadu.com reserves the right to make any decision in special cases on a case-by-case basis at its sole discretion, and which decision shall be final and binding.

 

IMPORTANT

1.            The payment of bonuses and/or other payments are subject to all taxes currently in force in accordance with any applicable laws, regulations, codes, and regulatory requirements as may be required from time to time.

2.            MakanMadu.com will comply with all tax reporting requirements in accordance with any applicable laws, regulations, codes, and regulatory requirements as may be required from time to time.

3.            For tax reporting purpose, the bonus and/or other payments are considered received by the membership upon the payment performed by MakanMadu.com through whatsoever payment method.
